No contracting out

In force

(1)

This Act has effect despite any stipulation in any contract or agreement to the contrary.

(2)

If the making of a contract contravenes this Act because the contract includes a particular provision, nothing in this Act affects the validity or enforceability of the contract otherwise than in relation to that provision, so far as that provision is severable.

(3)

Subsection (2) is subject to subsection (1) and to any order made under section 105 or 106.
