327 Requirement to surrender firearms and other things
When a firearms prohibition order is served on a person, the prohibited person must immediately surrender the following things to the police officer who served the firearms prohibition order —
any licence card in the person’s possession;
any firearm, major firearm part, prohibited accessory, firearm technology or ammunition in the person’s possession.
A person who contravenes subsection (1) by failing to immediately surrender a licence card commits a crime.
Penalty for this subsection: imprisonment for 5 years and a fine of $60 000.
A person who contravenes subsection (1) by failing to immediately surrender any of the following things commits a crime —
a firearm;
a major firearm part;
ammunition;
firearm technology.
Penalty for this subsection: imprisonment for 7 years.
A person who contravenes subsection (1) by failing to immediately surrender any of the following things commits a crime —
a handgun;
a prohibited firearm;
a major firearm part of a handgun or prohibited firearm;
a prohibited accessory.
Penalty for this subsection: imprisonment for 14 years.
A person does not commit an offence under this section by failing to immediately surrender a thing if —
the thing is not in the person’s immediate possession; and
the person immediately provides the police officer who served the firearms prohibition order with the information and assistance necessary to enable a police officer to immediately locate and access the thing for the purpose of seizing it.
