120 Owner to identify person in charge of carrier
The owner of a potential carrier shall, if required to do so by an authorised person, inform the authorised person of the identity and address of the person in charge of the potential carrier at the time when an offence relating to that potential carrier is alleged to have been committed against this Part.
Where an offence against this Part is alleged to have been committed by the person in charge of a potential carrier and the owner of that potential carrier fails, within 14 days of being required by an authorised person to identify the person who was in charge of the potential carrier at the time the offence was alleged to have been committed, to —
comply with that requirement; or
furnish information to an authorised person from which an authorised person is satisfied that the potential carrier was stolen or being unlawfully used at the time of the alleged offence or that the owner could not reasonably have been aware of the identity of the person in charge of the potential carrier at that time,
the owner shall be deemed to be the person who committed that offence and shall then be liable to the penalty prescribed in respect of that offence.
