1310 Application of r. 1302, 1303, 1304, 1305, 1306, 1308 and 1309 to Commissioner

(1)

Regulations 1302, 1303, 1304(1), 1305, 1306, 1308 and 1309 apply to the Commissioner as if —

(a)

references to a member were references to the Commissioner; and

(b)

references to the member’s officer in charge, Commissioner or Manager were references to the Minister.

(2)

In respect of a period of leave of absence approved under regulation 1304(1), as applied by subregulation (1), the Commissioner is entitled to receive any allowances that the Commissioner would have received under the terms of the Commissioner’s appointment if the Commissioner had not been incapacitated.

(3)

Subregulation (2) applies subject to any terms or conditions imposed under regulation 1304(1)(b), as applied by subregulation (1).

(4)

Subregulation (2) does not apply if the Commissioner is incapacitated through the Commissioner’s fault or misconduct.
