Retirement Villages Act 1992

Subject to subsection (2) and section 75, a prospective resident is entitled to rescind a residence contract entered into by that person —

at any time within 7 working days after the date of the contract; or

if section 13(2) is not complied with — at any time before the expiration of 17 working days after the date on which the documents required under that section are given to the prospective resident.

A person is not entitled to rescind a residence contract under this section after entering into occupation of residential premises in a retirement village under the residence contract.

This section applies despite, and does not limit any other entitlement to rescind a contract under, the Sale of Land Act 1970.
