40 Resident’s remedies for contraventions of Part
(1)
A resident may apply to the Tribunal for, and the Tribunal may make, an order requiring an operator to comply with any requirement in this Part.
(2)
The Tribunal’s power to make the order is not affected by —
(a)
the commencement of proceedings against the operator for an offence under this Part; or
(b)
the conviction of the operator in proceedings for the offence.
