Right of operator to compensation if resident abandons premises
69 Right of operator to compensation if resident abandons premises
If a resident of a retirement village abandons the residential premises, the resident is liable to pay compensation to the operator of the retirement village for any loss (including loss of rent) caused by the abandonment.
The operator must take all reasonable steps to mitigate the loss and is not entitled to compensation for any loss that could have been avoided by taking those steps.
The Tribunal may, on application by the operator, order the resident to pay to the operator such compensation (including compensation for loss of rent) as the Tribunal thinks fit.
