38 Refusal of application
(1)
The Board may refuse a Part 3 application if —
(a)
the application is not made in accordance with the requirements of this Division; or
(b)
the applicant does not comply with a requirement under section 37.
(2)
Subsection (1) does not limit the grounds on which the Board can refuse a Part 3 application.
(3)
If the Board refuses a Part 3 application, the Board must refund the registration fee that accompanied it.
