51 Circumstances of removal for physical or mental health reasons (section 11(1a))
A juvenile custodial officer or miscellaneous employee who is, in the opinion of the chief executive officer, unable to perform his or her duties properly by reason of his or her physical or mental health may be required by the chief executive officer to submit to a medical examination by a board consisting of a medical practitioner nominated by that juvenile custodial officer or miscellaneous employee, and 2 medical practitioners appointed by the Chief Health Officer.
If, 7 days prior to the day of examination, the juvenile custodial officer or miscellaneous employee has not nominated a medical practitioner who has consented to attend the medical examination, the Chief Health Officer may appoint all 3 medical practitioners to constitute the board.
If a board, or the majority of the members of a board, reports to the chief executive officer that a juvenile custodial officer or miscellaneous employee is unable to perform his or her duties properly by reason of his or her physical or mental health, the chief executive officer may remove the juvenile custodial officer or miscellaneous employee.
