Under s 23 of the Crimes (Sentencing Procedure) Act 1999 (NSW), where an offender's offer of future assistance to authorities is unlikely to be used, the sentencing judge is not required to give a large discount; the significance and usefulness of the proffered assistance must be evaluated, and where the likely usefulness is nil, the reward for willingness to assist need not be large. The proposition in R v Cartwright that the reward should be the same regardless of whether the assistance is actually effective does not survive the enactment of s 23.
