Fisheries Act 2000

This section applies if—

the conservator gives a show cause notice to a licensee for a fisheries licence; and

having regard to the grounds stated in the notice, the conservator believes on reasonable grounds that the fisheries licence should be suspended immediately because of a risk to—

public safety; or

sustainability of a species of fish or aquatic habitat; or

the safety of a fish.

The conservator must give the licensee a written notice (an immediate suspension notice) suspending the person’s licence.

The suspension of a fisheries licence under this section takes effect when the immediate suspension notice is given to the licensee.

The suspension of a fisheries licence under this section ends—

if regulatory action is taken against the person—at the earlier of the following times:

when the regulatory action takes effect;

30 days after the day the immediate suspension notice is given to the person; or

if regulatory action is not taken against the person—at the earlier of the following times:

when the person is given written notice of the conservator’s decision not to take regulatory action;

30 days after the day the immediate suspension notice is given to the person.
