84C Notice of LTCS levy—work injuries

(1)

If the LTCS commissioner determines a LTCS levy under section 84B, the commissioner must give each workers compensation insurer and licensed self‑insurer a written notice—

(a)

setting out the details of the levy; and

(b)

requiring the workers compensation insurer or licensed self‑insurer to pay the amount of the levy payable by the workers compensation insurer or licensed self‑insurer within the time stated in the notice.

(2)

If no time for payment is stated in the notice, payment must be made not later than 30 days after the day the workers compensation insurer or licensed self‑insurer receives the notice.

(3)

If a workers compensation insurer or licensed self‑insurer does not pay the levy payable by the insurer or licensed self‑insurer within the time required under the notice given to the insurer or licensed self‑insurer, or within the time required under subsection (2), the amount of the levy is a debt owing to the Territory by the insurer or licensed self‑insurer.

Note An amount owing under a law may be recovered as a debt in a court of competent jurisdiction or the ACAT (see Legislation Act, s 177).

(4)

The LTCS commissioner may amend or revoke a notice given under this section.
