21 Unauthorised use of mark
(1)
A person commits an offence if the person—
(a)
applies a registered mark to stock; and
(b)
is not—
(i)
the registered owner of the mark; or
(ii)
acting with the permission of the owner.
Maximum penalty: 50 penalty units.
(2)
A person commits an offence if the person—
(a)
applies a registered mark to stock; and
(b)
is not—
(i)
the owner of the stock; or
(ii)
acting with the permission of the owner.
Maximum penalty: 50 penalty units.
(3)
An offence against this section is a strict liability offence.
