Waste Management and Resource Recovery Act 2016

If the waste manager proposes taking regulatory action against a person, the waste manager must give the person a written notice (a show cause notice) stating—

the grounds on which, under section 44, the waste manager considers regulatory action may be taken; and

details of the proposed regulatory action; and

that the person may, not later than 14 days after the day the person is given the notice, give a written submission to the waste manager about the proposed regulatory action.

The waste manager must consider any submission received by the waste manager in response to the show cause notice when making a decision to take or not take regulatory action against the person.

However, subsection (2) does not apply if the waste manager gives the person an immediate suspension notice under section 48 (Immediate suspension of licence or registration if risk to public safety).
