106M Referral of matter to a regulatory body to be mentioned in Committee’s report

(1)

This section applies if, in the course of its investigation, the Committee:

(a)

formed an opinion that any conduct by the person under review caused, was causing, or was likely to cause, a significant threat to the life or health of any other person and sent a statement of its concerns to the Director under section 106XA; or

(b)

formed an opinion that the person under review failed to comply with professional standards and sent a statement of its concerns to the Director under section 106XB.

(2)

The Committee must mention that it has formed the opinion, and set out the terms of the statement, referred to in paragraph (1)(a) or (b):

(a)

if the statement was sent before the Committee prepared its draft report—in the draft report; and

(b)

in the final report.

(3)

The Committee must disregard any opinion formed as mentioned in subsection (1) when making findings for the purposes of its draft report or final report.
