106N Committee may refer material to Chief Executive Medicare if certain offences or civil contraventions are suspected
If the Committee thinks that the material before the Committee indicates that a person may have committed a relevant offence or a relevant civil contravention within the meaning of section 124B, or a relevant dental benefits offence, the Committee may send the material or a copy of the material to the Chief Executive Medicare together with a statement of the matters that it thinks may have constituted the offence or contravention.
If the Committee acts under subsection (1), the Committee may also:
notify the Director that the person may have committed the relevant offence, the relevant civil contravention or the relevant dental benefits offence; and
give the Director any additional information (including information about the person) in relation to the possible commission of that offence or contravention.
If the Committee gives the Director additional information that is not also given to the Chief Executive Medicare under subsection (1), the Director may disclose that additional information to the Chief Executive Medicare under subsection 89A(1) or 129E(4), whichever is applicable.
If material or a copy of material sent to the Chief Executive Medicare under subsection (1) relates to the referred services in relation to any Committee investigation resulting from a referral, the Committee may:
continue with its consideration of the referral; or
suspend its consideration of the referral for such period as it thinks appropriate.
