91 Decision to take no further action
The Director may decide to take no further action in relation to a review if he or she is satisfied that:
there are insufficient grounds on which a Committee could reasonably find that the person under review has engaged in inappropriate practice in providing services during the review period; or
circumstances exist that would make a proper investigation by a Committee impossible.
Within 7 days after making a decision to take no further action in relation to a review, the Director must give the Chief Executive Medicare and the person under review:
written notice of the decision; and
a written report setting out the grounds for the decision.
