92A If agreement is not ratified
If:
the Director enters into an agreement with the person under review; and
the Determining Authority refuses to ratify the agreement; and
before the end of the period of 3 months after the refusal:
the Director has not made a decision under section 91 to take no further action in relation to the review; or
the Determining Authority has not ratified a further agreement between the Director and the person under review; or
the Director has not made a referral to a Committee to investigate whether the person under review engaged in inappropriate practice in providing services during the review period;
then, the Director must make such a referral.
Subsection 92(5) provides for the making of further agreements following a refusal by the Determining Authority to ratify an agreement.
