61 Public disclosure of confidential information by the Minister

(1)

The Minister may publicly disclose protected information that is confidential information if:

(a)

the Minister has given a notice (the proposed disclosure notice) under subsection 43(1) in relation to the information; and

(b)

subsection (2) applies in relation to the information.

(2)

This subsection applies in relation to confidential information if any of the following apply:

(a)

no application in relation to the information has been made under subsection 44(1) within the time limit specified in the proposed disclosure notice;

(b)

an application in relation to the information that was made under subsection 44(1) is taken to have been withdrawn under subsection 45(3);

(c)

both of the following apply:

(i)

the Minister has decided under subsection 46(1) to not approve an application in relation to the information that was made under subsection 44(1);

(ii)

any reconsideration and review rights under sections 47 and 48 in relation to the decision have been exhausted or have expired.
