Repatriation Acts Amendment Act 1979

Part IIIa of the Repatriation Act 1920 applies to, and in relation to, a decision of an Appeal Tribunal or of an Assessment Appeal Tribunal made before the commencement of this Part as if—

where that decision was made on an appeal under section 64 of the Repatriation Act 1920, or section 8aa of the Seamen’s War Pensions and Allowances Act 1940, as in force before the commencement of this Part—that decision were a decision of the Repatriation Review Tribunal on a review in pursuance of an application under section 107vc of the Repatriation Act 1920 or section 34 of the Seamen’s War Pensions and Allowances Act 1940, whichever is the appropriate section;

where that decision was made on an appeal under section 67 of the Repatriation Act 1920, or section 8ab of the Seamen’s War Pensions and Allowances Act 1940, as in force before the commencement of this Part—that decision were a decision of the Repatriation Review Tribunal on a review in pursuance of an application under section 107vd of the Repatriation Act 1920 or section 35 of the Seamen’s War Pensions and Allowances Act 1940, whichever is the appropriate section; or

where that decision was made on an appeal under section 70 of the Repatriation Act 1920 as in force before the commencement of this Part—that decision were a decision of the Repatriation Review Tribunal on a review in pursuance of section 107ve of the Repatriation Act 1920.

For the purposes of the application, by virtue of sub-section (1) of this section, of section 107vzb of the Repatriation Act 1920 to, and in relation to, a decision of an Appeal Tribunal or an Assessment Appeal Tribunal, the reference in that section to the service, in accordance with section 107vk of that Act, of a copy of a decision of the Repatriation Review Tribunal shall be read as a reference to the furnishing to the Repatriation Commission of a copy of that first-mentioned decision.
