13C Personal information
At the time of lodging a public report under section 13A, a relevant employer must, in writing (either in the report or otherwise), inform the Agency of the information included in the report that is personal information.
Subject to subsection (3), that personal information:
must not be published under section 15; and
must not be used in a report under:
section 12; or
section 46 of the Public Governance, Performance and Accountability Act 2013.
However, such information may be used for the purposes of publishing information under subsection 15A(1) (see subsection 15A(3)). The publishing of information under subsection 15A(1) is subject to certain protections (see subsection 15A(4)).
Particular personal information may be so published or used if the individual to whom the information relates consents in writing to the publication or use.
