Determination of value of property disposed of
42 Determination of value of property disposed of
The Electoral Commission may, if it is of the opinion that the value of property disposed of has not been correctly stated, appoint or approve persons to assess the value of the property who have, for a period of (or for periods totalling not less than) 5 years, been engaged in making valuations of property of the same kind as that property.
However, the Electoral Commission may not appoint or approve any of the following persons to assess the value of the property—
candidates,
party or official agents,
persons appointed to any office or position under the Electoral Act 2017,
members of staff of the Electoral Commission.
A valuation made by a person appointed or approved in accordance with this clause is, for the purposes of the Act, taken to be a true valuation of the amount of a donation or expenditure consisting of a disposition of property.
