10.2 Commercial and non-residential floor space
The objectives of this clause are as follows—
to protect and enhance the retail and commercial core of St Marys Town Centre,
to reinforce the status of St Marys Town Centre as a strategic centre and as a place of employment,
to promote active street frontages in the commercial core,
to enable a flexible approach to the delivery of commercial and non-residential floor space in areas close to the transport interchange,
to ensure the delivery and long-term protection of employment generating floor space on certain land in St Marys Town Centre.
This clause applies to land identified as “Area 1” and “Area 2” on the Clause Application Map.
Development consent must not be granted to the erection of a building, or change of use of a building, on land to which this clause applies unless the consent authority is satisfied that—
a minimum amount of gross floor area equivalent to a floor space ratio of 1.4:1 will be used for non-residential purposes after the erection or change of use, or
the ground floor and first floor of the building will be used for non-residential purposes after the erection or change of use.
The floor space ratio of buildings on land identified as “Area 1” on the Clause Application Map may be greater than the maximum floor space ratio for the land if the consent authority is satisfied that the additional floor space will be used for non-residential development.
In this clause—
non-residential development means development for purposes other than residential accommodation or car parks.
