Survey of boundaries
30 Survey of boundaries
A surveyor carrying out a survey to define a boundary must—
ascertain the nature and position of monuments relevant to the survey, and
if the boundary has previously been surveyed—adopt the boundaries originally marked on the land, unless there is sufficient evidence that the marks have been disturbed, and
locate each structure and fence that is—
within 1m of the boundary of the land being surveyed, or
relevant to the definition of the boundary, and
ensure a boundary defined by the surveyor does not encroach on—
a road, or
an adjacent parcel of land.
Despite subsection (1)(b), a surveyor carrying out a survey to define a road boundary must adopt any existing boundaries defined by alignment marks, unless there is sufficient evidence that the marks have been disturbed.
