13 Waste and pollution
For the Act, section 89(1)(a)(i) and (ii), a person must not do the following—
bring waste into, or leave waste in, a controlled area,
pollute waters within a controlled area.
Maximum penalty—
for a corporation—200 penalty units, or
otherwise—100 penalty units.
A person does not commit an offence under this section for anything done in accordance with an environment protection licence.
In this section—
environment protection licence has the same meaning as in the Protection of the Environment Operations Act 1997.
pollute, in relation to waters, has the same meaning as water pollution has in the Protection of the Environment Operations Act 1997.
waste has the same meaning as in the Protection of the Environment Operations Act 1997.
waters has the same meaning as in the Protection of the Environment Operations Act 1997.
