48A Acquisition to be on just terms
(1)
If the application of a provision of this Act in a particular case would result in an acquisition of property otherwise than on just terms, the person from whom the property is acquired is entitled to such compensation as is necessary to ensure that the acquisition is on just terms.
(2)
A court of competent jurisdiction may determine the amount of compensation or make the orders that, in its opinion, are necessary to ensure that the acquisition is on just terms.
(3)
In subsection (1):
this Act includes the repealed Acts.
