38 Offences and penalties
(1)
A person shall not contravene or fail to comply with a provision of, or an order under, this Act or the Regulations.
(2)
A person who contravenes or fails to comply with a provision of, or an order under, this Act or the Regulations for which a penalty is not provided by a provision of this Act or the Regulations other than this section, is punishable upon being found guilty by a fine not exceeding 8 penalty units or imprisonment for 6 months.
(3)
A prosecution for an offence against a provision of, or an order under, this Act or the Regulations shall not be commenced unless approved by the Chief Health Officer.
