36 Public Trustee may act as sole trustee
Where a will, codicil, deed or other instrument provides for or directs the appointment of 2 or more trustees the trustees appointed under any such will, codicil, deed or other instrument or any other person having the power to appoint new trustees thereof may appoint the Public Trustee as sole trustee under the will, codicil, deed or other instrument unless the appointment of the Public Trustee as sole trustee is expressly prohibited by the will, codicil, deed or other instrument.
An appointment under subsection (1) may be made without obtaining the consent of the Court.
The Public Trustee appointed in pursuance of this section as a sole trustee may act lawfully as sole trustee.
