43 Public Trustee entitled to costs
On an application by the Public Trustee, whether in common form or in solemn form, for a grant of administration, the Public Trustee shall be entitled to his or her costs out of the estate and shall not be liable for the costs of any other person.
Where the beneficiaries entitled under an intestacy cannot agree as to the person to be appointed administrator, and the Public
Trustee, at the request of one or more of those beneficiaries, applies for a grant of administration, the Public Trustee shall not be liable for the costs of any other person, and shall be entitled to his or her costs out of the estate whether the Public Trustee is appointed the administrator or not.
