52 Refusal to accept by Public Trustee
The Public Trustee may refuse to accept an appointment in any capacity other than an appointment made by order of the Court.
Where the Public Trustee refuses to accept an appointment under subsection (1), the person making the appointment or a person beneficially entitled to an interest in property the subject of the appointment, or a person who is otherwise entitled to claim an interest as next friend or guardian ad litem on behalf of the person interested in property the subject of the appointment, may apply to the Court for an order that the Public Trustee be appointed.
Where the Public Trustee refuses an appointment under this section, the Public Trustee shall serve notice on all persons interested in the appointment.
