45 Trustees may delegate to Public Trustee
(1)
Where a trustee of a trust estate is empowered to delegate all or any of his or her functions, powers, authorities, discretions or rights to any person, he or she may delegate the same to the Public
Trustee with his or her consent and in any such case the Public
Trustee may exercise all the functions, powers, authorities, discretions and rights so delegated.
(2)
The Public Trustee shall be entitled to charge such fees as are prescribed or as may be agreed, not exceeding the prescribed fees where a fee is prescribed, by a trustee delegating to the Public
Trustee under subsection (1).
