61 Approval of compliance plans

(1) Where a draft compliance plan is submitted to the NT EPA under this Part, the NT EPA may approve or refuse to approve it.

(2) The NT EPA must notify the person who submitted the draft compliance plan of the NT EPA's decision under subsection (1).

(3) Where the NT EPA refuses under subsection (1) to approve a draft compliance plan, the NT EPA must specify in the notice under subsection (2) the reasons for the refusal.

(4) Where the NT EPA refuses under subsection (1) to approve a draft compliance plan that was required to be submitted under section 58, an order under section 59 or this subsection, the NT EPA may require in the notice under subsection (2) the person to submit a further draft compliance plan to the NT EPA before the date specified in the notice.

(5) A person required to prepare and submit a further draft compliance plan by a notice in accordance with subsection (4) must comply with the notice.

Penalty: environmental offence level 4.

(6) The NT EPA may prepare and approve a draft compliance plan in relation to a person where:

(a) the person has failed to submit a draft compliance plan he or she was required to submit to the NT EPA under section 58 or an order under section 59 or by a notice under subsection (2); or

(b) the person has submitted to the NT EPA 3 or more draft compliance plans he or she was required to submit to the NT EPA under section 58 or under an order under section 59 or by a notice under subsection (2) and the NT EPA has refused to approve all of them.

(7) The NT EPA must notify in writing the person in relation to whom a draft compliance plan is approved under subsection (6) of the approval and provide a copy of the compliance plan to him or her.

(8) The costs of preparing a draft compliance plan under subsection (6) are a debt due and payable by the person to whom the plan relates.
