19.10 Objections and setting aside summons

(1)

A person served with a summons for production or a summons to give evidence may:

(a)

notify the Court on attendance that he or she objects to producing a document or thing or giving evidence; or

(b)

before the date fixed for attendance – apply to the

Court, under Part 6, to have the summons set aside.

(2)

The Court may set aside a summons for production or a summons to give evidence or, in the case of a summons for production, may set aside a part of the summons.
