Forestry Act 1959

A person who is dissatisfied with a reviewable decision made by a delegate of the chief executive exercising a delegated function of the chief executive under section 96B (the original decision maker) may ask the chief executive to review the decision within 28 days after the person is notified of the decision.

The person reviewing the decision (the reviewer) must be more senior than the person who made the decision.

The reviewer—

may—

confirm the original decision; or

make another decision and, for that purpose, has the same powers as the original decision maker; and

must give the applicant a statement of reasons for his or her decision.

In this section—reviewable decision means—

a decision in relation to a permit under section 35;

a decision in relation to a licence under section 55;

a decision in relation to a permit, licence, lease, or other authority, or an agreement or contract, under section 56;

a decision in relation to a permit under section 73(2).
