Prescribed place taken to be restricted premises for 2 years
42 Prescribed place taken to be restricted premises for 2 years
A prescribed place is taken to be restricted premises for 2 years starting on the commencement (the initial period).
For section 54—
the owner or occupier of the prescribed place is taken to have been served with a restricted premises order for the prescribed place, including the condition mentioned in section 37(2), on the commencement; and
the restricted premises order mentioned in paragraph (a) is taken to remain in force for the initial period.
To remove any doubt, if a regulation made under section 41(1) after the commencement omits a place prescribed by regulation on commencement, the place stops being a prescribed place.
