48 Complaints made or referred to the commissioner
This section applies to a complaint made or referred to the commissioner under section 45 or 46(3)(a).
The commissioner may deal with or refuse to deal with the complaint.
Also, the commissioner may, after deciding to deal with the complaint, refuse to continue to deal with the complaint.
However, the commissioner may refuse to deal with or to continue to deal with the complaint only if the commissioner is satisfied—
there is a more appropriate course of action available under another law to deal with the subject of the complaint; or
the subject of the complaint is being, or has been, appropriately dealt with by the commissioner or another entity; or
the requirements under section 47 have not been met; or
the complaint is frivolous or vexatious.
The commissioner must advise the complainant about the commissioner’s decision under this section to deal with, refuse to deal with or refuse to continue to deal with the complaint.
