Effect of disposal of part of land to which water licence to take water attaches

In force

(1)

This section applies if—

(a)

a water licence of either of the following types attaches to land—

(i)

a licence to take water;

(ii)

a licence mentioned in section 107(1)(c) of the Act; and

(b)

the registered owner (the disposer) of the land disposes of part of the land.

(2)

On the day the disposer disposes of the part, the water licence is taken to be held jointly by all owners of the land to which the licence attaches.

(3)

The chief executive must give all owners of the land to which the water licence attaches, other than the disposer, a copy of the licence.
