42 Effect of disposal of part of land to which water licence to interfere with water attaches
This section applies if—
a water licence to interfere with the flow of water on, under or adjoining land is attached to land; and
the registered owner of the land disposes of part of the land.
Subsection (3) applies if the location at which water may be interfered with is on, under or adjoining either the part of the land disposed of or the part retained by the owner.
The licence attaches to the part and the chief executive must amend the licence under section 132 of the Act, to show the change.
Subsection (5) applies if the location at which water may be interfered with is on, under or adjoining both the part of the land disposed of and the part retained.
The chief executive must amend the licence under section 132 of the Act, so that the licence is held jointly by both the owner of the part retained and the owner of the part disposed of.
