A person must not give a document for this Act containing information the person knows is false, misleading or incomplete in a material particular.Maximum penalty—100 penalty units or imprisonment for 6 months.
Example—
an applicant knowingly giving the chief executive an application form containing false information
Subsection (1) does not apply to a person who, when giving the document—
informs the person to whom the document is given, to the best of the person’s ability, how it is false, misleading or incomplete; and
if the person giving the document has, or can reasonably obtain, the correct information—gives the correct information.
It is enough for a complaint against a person for an offence against subsection (1) to state that the document was false, misleading or incomplete to the person’s knowledge.
