Appointment as manager of unclaimed property
34 Appointment as manager of unclaimed property
The Public Trustee may be appointed manager of property in this
State if, after due inquiry, it has not been possible to find the owner of the property or an agent or administrator in this State with authority to take possession of and administer the property.
The Court may appoint the Public Trustee as manager of property on application made without notice to any person by the Public Trustee and on being satisfied that the appointment is advisable—
in the interests of the owner of the property or of any other person; or
to secure the development or better utilisation of land.
Notice of the appointment must be published in the
Gazette.
The Court may, if it thinks fit, adjourn an application and order the Public Trustee to make further inquiries, publish advertisements or give notices as required by the Court in order to find the owner of the property or the owner's agent or administrator or to determine whether the property is subject to a trust.
