182 Reliance on reports of medical panel or medical practitioner

A report by a medical panel in relation to a medical question in respect of a person who has an asbestos-related disease may not be used – by the Commissioner in relation to the determination of an application under this Act unless a copy of the report is served on the person who made the application; or by a party in proceedings before the Tribunal or a court unless a copy of the report is served on each other party to the proceedings.

A report by a medical practitioner, including an accredited impairment assessor, in respect of a person who has an asbestos-related disease may not be used by a party as evidence in proceedings before the Tribunal or a court unless a copy of the report is served on each other party to the proceedings.

A medical certificate given by a medical practitioner, including an accredited impairment assessor, in respect of a person who has an asbestos-related disease may not be used – by the Commissioner in relation to the determination of an application under this Act, unless a copy of the certificate is served on the person who made the application; or by a party in proceedings before the Tribunal or a court, unless a copy of the certificate is served on each other party to the proceedings.
