A prisoner who has been sentenced to a term of imprisonment is not to be released on parole in respect of that sentence if – the court has ordered that the prisoner is ineligible for parole pursuant to section 17 or 18 of the Sentencing Act 1997; or the prisoner is ineligible for parole by operation of section 17(3A) of that Act.

If a prisoner is made the subject of a declaration under section 7 of the Dangerous Criminals and High Risk Offenders Act 2021, the prisoner is not eligible to be released on parole until the declaration is discharged under that Act.
