Education Act 2016

A State school is to have a school association.

A school association may be the school association for more than one school if the Minister so approves.

The name of a school association is to be – the name of the school or schools of which it is the school association followed by the words "School Association" or "College Association"; or if the Minister, in writing, approves another name, that other name.

A school association – is a body corporate with perpetual succession; and may have a seal; and may sue and be sued in its corporate name; and must have a constitution approved by the Minister; and consists of the members as established by its constitution; and has the functions and powers prescribed by this Act and its constitution.

A school association is not – an association for the purposes of the Associations Incorporation Act 1964; or the Crown or an agency or instrumentality of the Crown.

If a school association has a seal – it may be kept and used as authorised by the school association; and all courts and persons acting judicially must take judicial notice of the imprint of the seal on a document and presume that it was duly sealed by the school association.
