Explosives Act 2012

If – a person is convicted by a court of an offence in relation to an explosive; and the person owns the explosive or the owner cannot be identified – the court may, in addition to imposing any other penalty, order the explosive (and, if applicable, its container) to be forfeited to the Crown.

The explosive so forfeited to the Crown (and, if applicable, its container) may be destroyed, sold or otherwise disposed of as the Secretary, having regard to any relevant safety considerations, thinks fit.

Any costs reasonably incurred in effecting the destruction, sale or other disposal are recoverable from the convicted person as a debt due to the Crown.
