Forest Management Act 2013

In this section – authorised officer means a person appointed as an authorised officer under subsection (2).

The Forest Manager may appoint any of its employees to be an authorised officer for the purpose of this section.

An authorised officer may request a person – not to enter permanent timber production zone land or a forest road; or to leave permanent timber production zone land or a forest road; or to cease to undertake an activity conducted, or to cease to engage in conduct, on that land or road – if the authorised officer is of the opinion that the entry or presence of that person, or the activity conducted, or the conduct engaged in, by that person on the land or road is preventing, has prevented or is about to prevent the Forest Manager from effectively or efficiently performing its functions.

An authorised officer may prohibit a person from entering, or remaining in, an area of permanent timber production zone land – that has been declared under section 68 of the Fire Service Act 1979 to be an area of extreme fire hazard; or that is an area in respect of which another person has a right of exclusive possession; or in the interests of a person's safety.

A person who fails to comply with a request from an authorised officer under subsection (3) or (4) is guilty of an offence. Fine not exceeding 20 penalty units.

A person must not, without lawful excuse, undertake an activity or engage in conduct on permanent timber production zone land or a forest road contrary to the directions of a police officer. Fine not exceeding 20 penalty units.

A police officer may arrest, without warrant, any person who fails to comply with a direction under subsection (6).

In any proceedings under subsection (5), a certificate purporting to be signed by a person authorised, in writing, by the Forest Manager stating that at a particular time a person was an authorised officer is admissible as evidence that, the person was, at that time, an authorised officer.
