43 Inquiry into complaint by commission
As soon as practicable after being appointed to examine a complaint, a commission must conduct an inquiry into the complaint.
In conducting an inquiry into a complaint in respect of a judicial officer, a commission – is to consider the specific allegations that form the subject matter of the complaint; and may consider any matter that the commission considers relevant to whether the judicial officer is unable, or unfit, to perform the functions of the relevant judicial office; and may not consider a matter arising before the appointment of the judicial officer to the relevant judicial office unless the commission considers it relevant to whether the judicial officer is unable, or unfit, to perform the functions of the relevant judicial office; and may initiate such inquiries into the subject matter of the complaint as the commission considers appropriate.
Except as otherwise provided by this Act, an inquiry of a commission may be conducted in such manner as the commission determines.
