47 Powers relating to witnesses, &c., at hearing of commission
The presiding member of a commission, or a person authorised in writing by the presiding member, may issue a subpoena requiring a person to appear before the commission at a hearing, at a specified time and place, to do either or both of the following:to give evidence; to produce a specified document, or other thing, relevant to the hearing.
A person is taken to have complied with a subpoena under subsection (1)(b) if the person gives the relevant document or other thing to the commission before the date specified in the subpoena for its production.
The presiding member of a commission may require a witness, appearing at a hearing before the commission to give evidence, to do one or more of the following:to take an oath or give an affirmation; to answer a question relevant to the hearing; to produce a specified document, or other thing, relevant to the hearing.
The following persons may examine or cross-examine a witness at a hearing of a complaint if the relevant commission is satisfied on reasonable grounds that the matter is relevant and appropriate to its inquiry into the complaint:an Australian legal practitioner assisting the commission; the relevant judicial officer or the Australian legal practitioner representing the relevant judicial officer; any other person present, whom the commission permits to do so.
