Public Health Act 1997

On the day on which the Public Health Amendment (Vaping) Act 2025 commences, a smoking product licence that was issued, in respect of more than one smoking product, before the commencement of that Act – is taken to be issued in respect of a tobacco product, if the licence is issued to a person who is not the owner of a pharmacy business, within the meaning of the Pharmacy Control Act 2001; and is taken to be issued in respect of a personal vaporiser product, if the licence is issued to the owner of a pharmacy business, within the meaning of that Act.

On the day on which the Public Health Amendment (Vaping) Act 2025 commences, a smoking product licence issued in respect of a personal vaporiser product is void if the holder of the licence is not the owner of a pharmacy business, within the meaning of the Pharmacy Control Act 2001.

Except as specified under subsections (1) and (2), a smoking product licence that was in force immediately before the commencement of the Public Health Amendment (Vaping) Act 2025 continues in force after that commencement day on the same terms and conditions.
