43 Court orders on finding of guilt
If a person is found guilty of an offence under section 33, 34 or 35, the court determining the proceedings for the offence may, in addition to any other order, make an order for compensation to be paid to TasTAFE in respect of – any profit made by the person, or another person, as a result of the commission of the offence; and an amount equal to the loss and damage suffered by TasTAFE as a result of the commission of the offence.
Nothing in subsection (1) prevents TasTAFE from applying to a court of competent jurisdiction to recover an amount referred to in that subsection, as a debt due and owing by the person convicted of the offence, if an order for compensation is not made at the time at which the person is found guilty of the offence.
