31 Declaration of regulated activities and non-regulated activities
The Minister may, by order, declare – an activity to be a regulated activity; or an activity to not be a regulated activity – if the Minister is satisfied that it is in the public interest to do so.
Before making an order under subsection (1), the Minister must obtain the advice of the Regulator as to whether an activity should be declared to be a regulated activity or to not be a regulated activity.
The Regulator may at any time recommend to the Minister that an activity be declared to be a regulated activity or to not be a regulated activity.
